APEX PRIVACY POLICY

VortexAI LLC ("we," "us," "our") operates the Apex mobile application ("Apex," "the App"). This Privacy Policy explains what information we collect, how we use it, and your rights regarding that information. By using Apex, you agree to the collection and use of information in accordance with this policy.

1. INFORMATION WE COLLECT

Account Information: When you create an account, we collect your name, email address, password (stored securely using industry-standard encryption; we never store passwords in plain text), and profile picture (optional).

Profile & Fitness Information: To personalize your workout program, we collect your gender, age, weight and height, fitness goals, available training equipment, and training frequency preferences.

Usage & Progress Data: We collect data generated through your use of the app, including workouts completed, exercise performance (reps, sets, weights used), streak history, XP, level, and rank progression, and post-workout feedback you provide.

Squad & Social Data: If you join or create a Squad, we collect your squad membership and squad name, messages you send in squad chat, your workout counts as visible to other squad members, and your overall rank as visible to other squad members.

Subscription & Payment Information: Payments are processed through Apple's In-App Purchase system. We do not directly collect or store your payment card information. Apple's own privacy policy governs the handling of payment data.

Device & Technical Information: We may automatically collect device type and operating system version, app usage analytics (crash reports, feature usage), and IP address.

2. HOW WE USE YOUR INFORMATION

We use the information we collect to create and maintain your account, generate personalized AI-driven workout programs, track and display your progress, streaks, XP, and ranks, enable Squad features including leaderboards and chat, process subscription payments through Apple, send push notifications related to your activity (streaks, rank progress, squad activity, subscription reminders), improve and maintain the App, and respond to support requests.

3. AI COACH & THIRD-PARTY AI PROCESSING

Apex uses a third-party artificial intelligence service to generate personalized workout recommendations and coaching feedback. To provide this feature, relevant profile and progress data (such as your goals, equipment, workout history, and feedback) is shared with our AI service provider for the sole purpose of generating your personalized content. This data is transmitted securely and is not used by us for any purpose beyond providing the App's core functionality.

4. HOW WE STORE AND PROTECT YOUR INFORMATION

Your data is stored using Google Firebase, a cloud database and backend service. We implement reasonable technical and organizational measures designed to protect your information, including secure authentication and encrypted data transmission. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

5. SHARING YOUR INFORMATION

We do not sell your personal information. We may share information with service providers who help us operate the App (e.g., Firebase for data storage, our AI service provider for workout generation, Apple for payment processing), with other members of a Squad you join limited to your name, profile picture, workout count, chat messages, and overall rank, if required by law, legal process, or to protect the rights, property, or safety of VortexAI LLC, our users, or others, or in connection with a merger, acquisition, or sale of assets, with notice to you.

6. YOUR RIGHTS AND CHOICES

You may access and update your profile information within the App, delete your account (which will remove your personal information from our active systems, subject to any legal retention requirements), adjust notification preferences within the App's settings, and leave any Squad you have joined at any time. To request account deletion or data access outside the App, contact us at support@vortexai.dev.

7. CHILDREN'S PRIVACY

Apex is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected such information without parental consent, we will take steps to delete it.

8. DATA RETENTION

We retain your information for as long as your account is active or as needed to provide you the App's services. If you delete your account, we will delete or anonymize your personal information, except where retention is required for legal, security, or legitimate business purposes.

9. THIRD-PARTY SERVICES

Apex relies on the following third-party services, each governed by their own privacy policies: Apple (App Store, In-App Purchases, Sign in with Apple), Google Firebase (authentication, database, cloud functions), and our AI service provider.

10. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. We will notify you of any material changes by updating the "Last Updated" date at the top of this policy and, where appropriate, through an in-app notice.
